Adoption Attorney in Tampa Bay and Across Florida

Adoption Is Not One Story

Adoption stories take many forms. Sometimes a grandparent or relative steps in to provide a child with a permanent home. Sometimes a stepparent seeks to establish a legal parent-child relationship built through years of care and commitment. And sometimes adoption recognizes a family relationship that continues into adulthood.

Other adoption stories are more complicated. Parents may disagree. Relatives and foster families may be seeking permanency for the same child. An adoption may involve the Florida dependency system, disputed parental rights, or difficult questions about a child’s future.

Different Roles. Distinct Responsibilities. One Commitment to Ethical Adoption.

Adoption law involves many participants whose rights, responsibilities, and interests may differ. Meister Law Group’s adoption practice encompasses serving as an attorney adoption entity and providing legal representation to individuals involved in adoption proceedings, including prospective adoptive parents, birth parents, relatives, caregivers, and foster parents.

The capacity in which we serve is determined separately for each matter. We clearly identify whom we represent, the scope of our services, and the professional responsibilities associated with our role. Serving as an adoption entity is distinct from undertaking independent legal representation of an individual participant. We do not undertake representations prohibited by applicable conflict-of-interest rules.

Regardless of our role, our commitment remains the same: informed decisions, respect for parental rights, thoughtful legal advocacy, and legally sound adoption practices.

Private and Independent Adoption

Private and independent adoptions involve significant legal decisions affecting children, birth families, and prospective adoptive parents. Florida law establishes specific requirements governing placement, parental consent, termination of parental rights, adoption entities, and finalization.

Meister Law Group handles private and independent adoptions in different professional capacities depending on the circumstances of each matter.

adoption lawyer

Attorney Jennifer Meister may serve as an attorney adoption entity under Florida’s Adoption Act, undertaking the statutory responsibilities applicable to that role. In other matters, the firm may provide legal representation to an individual participant in the adoption process.

Our approach recognizes that adoption is not simply the creation of a new legal family relationship. It also affects existing family relationships, identities, and connections.

We are committed to ethical adoption practices that respect the dignity of everyone involved and recognize the lifelong significance of adoption.

Prospective Adoptive Parent Representation

Prospective adoptive parents often begin their adoption journey with questions about their legal rights, responsibilities, and the process necessary to establish a permanent parent-child relationship.

Meister Law Group provides legal representation to prospective adoptive parents in private and independent adoption matters, including guidance concerning adoption procedures, placement considerations, parental consent, termination of parental rights, statutory compliance, and finalization.

We help clients understand their legal options, anticipate potential complications, and navigate the adoption process with informed expectations and careful preparation.

When Attorney Jennifer Meister serves as an adoption entity, the nature and scope of that role are separately established and communicated. Adoption-entity services do not, by themselves, establish that the firm has undertaken individual legal representation of prospective adoptive parents.

Our commitment is to provide diligent legal representation while respecting the rights of birth parents and recognizing the interests of the children whose lives will be affected.

Birth Mother and Birth Father Representation: Continuing to Parent Is Also a Choice

Considering adoption does not mean choosing adoption.

At Meister Law Group, we believe expectant mothers, expectant fathers, and birth parents deserve more than an explanation of how to consent to an adoption. They deserve accurate information, education, independent legal guidance, and meaningful opportunities to understand their rights and make informed decisions about their children’s futures.

Meister Law Group provides independent legal representation to birth mothers and birth fathers concerning parental rights, paternity, notice and consent requirements, adoption proceedings, and the legal consequences of adoption-related decisions.

Adoption

Birth Fathers Matter. A father’s role should not be reduced to a signature, a notice requirement, or an obstacle to adoption. Fathers deserve to understand their legal rights, the steps necessary to establish or preserve those rights, and the responsibilities that accompany parenthood.

We believe choosing to continue parenting deserves the same thoughtful consideration, accurate information, and meaningful support as choosing adoption. When appropriate, we help connect expectant parents and birth parents with parenting education, community organizations, and available resources so that continuing to parent can be a realistic, informed option.

For parents considering adoption, we also provide guidance concerning legally permissible post-adoption communication and contact, recognizing the importance of family connections when consistent with the child’s best interests.

When representing a birth mother or birth father, our professional responsibility is to that individual client. We distinguish independent birth-parent representation from matters in which the firm serves as an adoption entity or represents another participant.

Our role is not to choose a path for a parent. It is to ensure that their decisions are informed, their legal rights are respected, and their voices are heard.

Open Adoption and Post-Adoption Contact Agreements

Adoption can change a child’s legal relationships without requiring every meaningful family connection to disappear.

At Meister Law Group, we recognize that adoption is not simply a new beginning. Every adopted child has a history, an identity, and relationships that may remain important and safe throughout their life.

Open adoption provides opportunities for continued communication and connection between adoptive families and members of a child’s birth family. Depending on the circumstances, this may include sharing photographs and updates, exchanging letters, arranging visits, or maintaining relationships with siblings and other relatives.

We believe these relationships deserve thoughtful consideration, particularly when continued contact can support a child’s identity, emotional well-being, and sense of belonging.

Open adoption and legally enforceable post-adoption contact arrangements are not necessarily the same thing.

Florida law provides specific procedures for certain court-ordered post-adoption communication and contact arrangements, particularly in adoptions arising from the dependency system. In other adoption circumstances, families may consider voluntary agreements concerning ongoing communication, but the legal effect and enforceability of those arrangements can differ.

Meister Law Group assists with the development, negotiation, and review of post-adoption contact agreements (PACAs). We help clients consider the practical details of continued contact, including the frequency and methods of communication, boundaries, expectations, and procedures for addressing future disagreements.

We also offer mediation services to help birth families and prospective adoptive parents explore mutually acceptable arrangements for continued communication and contact. In that capacity, the mediator serves as a neutral facilitator rather than an advocate for either party. Each participant is encouraged to obtain independent legal advice concerning their rights and the legal effect of any proposed agreement.

We believe that agreements concerning continued family connections should be informed, realistic, respectful of everyone involved, and centered on the child’s best interests.

Caregiver and Foster Parent Representation: Adoption Placement Disputes and AARC Proceedings

For many children involved in Florida’s dependency system, foster parents, relative caregivers, and other custodial caregivers provide stability, security, and continuity during periods of significant uncertainty.

When adoption becomes a permanency goal, these caregivers may encounter difficult legal questions concerning placement preferences, competing adoption applications, approval of adoptive home studies, and decisions made by the Department of Children and Families or its contracted agencies.

Meister Law Group provides legal representation to foster parents, relative caregivers, and other eligible caregivers in adoption-related matters, including disputed adoptive placements, competing applications, and proceedings involving the Adoption Applicant Review Committee (AARC).

An AARC may review competing approved adoption applications, including situations involving multiple prospective adoptive families or concerns regarding an applicant’s suitability. The committee makes recommendations within Florida’s adoption approval process, and the Department is responsible for the final application decision.

We assist clients with understanding the applicable legal standards, preparing for committee review, presenting relevant information, responding to adverse recommendations, and evaluating available legal remedies.

When an adoption application is denied, we evaluate whether judicial review or other relief may be available under Florida law, including section 39.812, Florida Statutes.

We understand that an existing caregiving relationship may be profoundly important to a child. At the same time, the legal significance of that relationship depends on the applicable statutes, placement preferences, procedural requirements, and the child’s individual circumstances.

Our goal is to ensure that caregivers understand their rights, that their positions are effectively presented, and that agency decisions receive appropriate legal scrutiny when warranted.

The people who have cared for a child deserve to understand the legal process that may determine that child’s permanent home.

Stepparent Adoption

A stepparent adoption can formally recognize and secure a parent-child relationship built through years of care, commitment, and shared family life.

Stepparent adoption allows a spouse to establish a permanent legal parent-child relationship with their spouse’s child. Although these adoptions may be relatively straightforward when the necessary consents are obtained, complications can arise when another parent cannot be located, refuses to consent, or disputes the adoption.

Meister Law Group assists families with uncontested and contested stepparent adoptions, including evaluating consent requirements, addressing parental rights disputes, preparing the necessary filings, and obtaining final judgments of adoption.

Relative Adoption

Grandparents, aunts, uncles, and adult siblings sometimes step in to raise a child when a parent is unable to do so. Adoption can provide permanency and security to these families.

Florida’s Adoption Act provides specific procedures for qualifying relative adoptions. Whether a family member qualifies depends on the applicable statutory definition and the nature of the family relationship.

Meister Law Group helps relatives determine whether they qualify for these procedures, evaluate the legal rights of the child’s parents, address contested issues when necessary, and pursue a legally sound path to permanency for the child.

Foster Care and Dependency Adoption

Adoptions arising from Florida’s dependency system present legal considerations that differ from private and independent adoptions.

These matters may involve prior child welfare proceedings, termination of parental rights under Chapter 39, permanency planning, placement decisions, and the transition from dependency proceedings to adoption finalization.

Meister Law Group assists foster parents, relatives, and other prospective adoptive parents in understanding and navigating the legal process associated with dependency-related adoptions.

Attorney Jennifer Meister’s over 16 years of experience as a former Senior Attorney with the Department of Children and Families’ Children’s Legal Services and as an Assistant Attorney General provides valuable insight into the legal and procedural issues that can arise when adoption intersects with Florida’s child welfare system.

We recognize that children involved in dependency proceedings may have experienced significant instability, separation, and trauma. Our approach emphasizes careful legal preparation, respect for existing relationships, and thoughtful consideration of each child’s individual circumstances.
